§1 General Provisions

These Terms and Conditions define the rules for using the online store LABORATORY ANDRE ZAGOZDA available at:

These Terms and Conditions define in particular:

  • rules for using the Store
  • rules for placing orders
  • rules for concluding sales agreements
  • payment and delivery terms
  • complaint procedures
  • rules for withdrawal from the agreement
  • rules for providing electronic services

These Terms and Conditions constitute an integral part of the sales agreement concluded between the Seller and the Customer.

Agreements concluded via the Store are made in the Polish language.


§2 Definitions

Seller – LABORATORY ANDRE ZAGOZDA PL SP. Z O.O.

Customer – a natural person, legal entity, or organizational unit making a purchase in the Store.

Consumer – a natural person performing a legal act not directly related to their business or professional activity.

Entrepreneur with Consumer Rights – a natural person conducting business activity entering into an agreement not directly related to their professional activity.

Goods – products offered in the Store.

Price – the gross value of the Goods including VAT.

Order – a declaration of intent by the Customer aimed at concluding a sales agreement.

Customer Account – an electronic service allowing storage of Customer data and order history.

Sales Agreement – a distance contract concluded between the Seller and the Customer.


§3 Technical Requirements

In order to use the Store, the following are required:

  • a device with Internet access
  • an up-to-date web browser
  • an active e-mail account
  • cookies enabled
  • JavaScript enabled


§4 Terms of Using the Store

Using the Store is voluntary and free of charge.

The Customer may place orders:

  • after creating a Customer Account
  • without registration (guest checkout)

The Customer is obliged to:

  • provide accurate data
  • use the Store in accordance with applicable law
  • not submit unlawful content


§5 Placing Orders

Orders may be placed using the order form available in the Store.

In order to place an order, the Customer must:

  • select Goods
  • add them to the cart
  • enter delivery details
  • choose payment and delivery method
  • accept the Terms and Conditions
  • confirm the order

After placing an order, the Customer receives an e-mail confirming receipt of the order.

The sales agreement is concluded when the Customer receives confirmation that the order has been accepted for processing.


§6 Prices and Payments

All prices in the Store are gross prices and include VAT.

The delivery cost is added to the price of the Goods during the ordering process.

Available payment methods include:

  • bank transfer
  • online payment (e.g. Przelewy24, PayU)
  • payment card
  • cash on delivery – if available

§7 Delivery

Delivery of Goods is carried out within Poland and selected European Union countries indicated during the ordering process.

Deliveries are made via courier companies or other delivery methods available in the Store.

§8 Complaints

The Seller is obliged to deliver Goods in conformity with the agreement.

The basis for a complaint may be the non-conformity of the Goods with the agreement.

Complaints may be submitted:

  • by e-mail: office@andrezagozda.com
  • in writing to the Seller's registered address

The complaint should include:

  • Customer details
  • order number
  • description of the issue
  • Customer request

Complaints are processed within 14 days.


§9 Right of Withdrawal

The Consumer has the right to withdraw from the agreement within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which the Consumer receives the Goods.

To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by means of a clear statement.

The Consumer must return the Goods no later than 14 days from the day of withdrawal from the agreement.

The Consumer bears the direct cost of returning the Goods.

The refund will be made no later than 14 days after receiving the withdrawal statement.


§10 Exceptions to the Right of Withdrawal

The right of withdrawal from the agreement does not apply to contracts concerning:

  • products delivered in sealed packaging which cannot be returned once the seal has been opened or broken for reasons of health protection or hygiene
  • products whose packaging has been opened, unsealed or otherwise tampered with after delivery, if the product shows signs of use beyond what is necessary to establish the nature, characteristics and functioning of the product
  • products made to the Customer’s individual order
  • perishable products or products with a short shelf life


§11 Electronic Services

The Seller provides the following electronic services:

  • Customer Account
  • order form
  • contact form

These services are provided free of charge.


§12 Personal Data Protection

The controller of personal data is LABORATORY ANDRE ZAGOZDA PL SP. Z O.O.

Personal data are processed in accordance with the GDPR.

§13 Out-of-court Dispute Resolution

Consumers may use out-of-court methods of dispute resolution.

§14 Final Provisions

These Terms and Conditions enter into force on the date of publication on the Store website.

The Seller may amend the Terms and Conditions for important reasons, in particular in the event of:

  • changes in legal regulations
  • changes in payment methods
  • changes in delivery methods
  • changes in Store functionality

Agreements concluded before the change of the Terms and Conditions shall be governed by the version applicable on the date of conclusion of the agreement.
